Taking Properties is now Harder and More Expensive
Following a U.S. Supreme Court Decision, Massachusetts has amended its laws regarding how municipalities must act when seeking to take properties that are delinquent on property taxes or fees. The result is that municipalities must:
Spend more up front to proceed with such takings;
Wait longer to complete legal processes; and
Pay full (or even excess) value for any properties retained.
As a result, only in rare instances will it make sense for Plymouth to undertake a tax foreclosure for public or charitable use.
